Expert Witness for Firearms Cases in Massachusetts

Carrying a firearm in Massachusetts without a valid license is a serious felony with a minimum mandatory sentence of 18 months in jail and a maximum potential sentence of up to 5 years in prison. Attorneys representing clients who are facing potential mandatory jail time need access to every potential defense tool available.

Attorney Guida is the former Keeper of Records for all firearms licenses and firearms transactions in the Commonwealth. He has been qualified as an expert witness in criminal prosecutions for both the Commonwealth and the defense. He can assist defense attorneys who are seeking to challenge evidence of lack of licensure offered by prosecutors subsequent to the April, 2023 Guardado decision by pointing out potential flaws in the licensing process/database. His testimony can also address:

  1. firearms licensing and the firearms licensing process
  2. firearms purchasing and sale process and regulations governing firearms dealers
  3. firearms license and firearms transaction/sale/transfer records
  4. the validity of evidence that a criminal defendant did not hold an LTC or FID
  5. exemptions to firearms licensing, including grace periods and the “safe harbor” provision
  6. “assault-style” firearms ban and “pre-ban” determinations under Ch. 135 of the Acts of 2024
  7. large capacity magazine issues
  8. federal and state prohibited person statuses

Attorney Guida is an approved Committee for Public Counsel Services (CPCS) vendor. He provides a no-cost case consultation for defense attorneys seeking to hire him as an expert witness.

Defense attorneys seeking to retain his services should email the office at 2A@lawguida.com and provide the case name and anticipated trial date.
