LTC restrictions no longer enforceable

On August 10, 2022, Massachusetts, complying with the recent Bruen decision, repealed the legislative language that permitted police departments to impose carry restrictions on LTCs as well as the criminal penalties that could be imposed for carrying outside of a restriction.

The new legislation, Chapter 174 of the Acts of 2022, was passed with an emergency preamble, which means it was effective immediately upon the Governor’s signature. (Read the new bill here: https://malegislature.gov/Laws/SessionLaws/Acts/2022/Chapter175).

If you currently hold an LTC that was restricted by your police department, that restriction is no longer enforceable. LTC holders may now safely and lawfully carry a firearm for all lawful purposes (being mindful of school zones, government buildings and private property where firearms are prohibited).

It is possible that some law enforcement officers remain unaware of the recent changes despite the publicity that the legislation received. If you encounter a law enforcement action when carrying outside of an LTC restriction (LTC seized, charges filed), contact our office as soon as possible.

    Hello,I was arrested for OUI in 2000 March 8 th.and driving with suspended license in 2001..I was driving my pregnant wife to the hospital. Do you think I can get my license to carry? James thank you.

    I was issued my LTC in late June of this year through the Arlington PD with a “stun gun only” restriction printed on the license. I went in to buy a firearm today and they turned me away. Why would I have received that kind of a restriction?

      Police can no longer restrict LTCs. It is possible that they chose to limit your access to firearms due to something in your background check. You should contact the licensing officer to discuss.

      The criminal penalty associated with violating a restriction was repealed by the Legislature in late 2022 – so feel free to carry if you wish. Additionally, most PDs will reprint an active LTC that has restrictions on it and reissue with no restrictions.

    Ken so the new law states correct me if I’m wrong. So in 2020 I got issue a restricted LTC in Massachusetts expired date of 2026 . I should have my local PD reissue a nonrestricted LTC or Wait to it time to renew and until then I’m compliant the Carry outside my home if I choose

      1) you can request that your PD issue you an unrestricted LTC or 2) you can do nothing – the law prohibiting carry outside of a restriction was repealed meaning you can carry ALP on your current LTC

    hi I got in trouble in 2016 with a misdemeanor drug possession charge only time I’ve ever been in any type of trouble. There telling me I still can’t get my ltc because I plead guilty to it. Can you help?
